 I can't understand the explanation of two question from the test:

5) Your company is receiving a shipment of goods from the seller when you get a call from the 
contracting officer who tells you that the shipment does not meet the requirements of the contract. 
You look at the shipment yourself and determine that the shipment meets the needs of the project. 
What should you do?
A) Send the shipment back
B) Accept the shipment
C) Issue a change order to change the contract specifications
D) Expect to receive a claim from the seller

Why shouldn't you wait for official claims for breaching contract? I understand that contracting officer is an expert, but he just calls you. It is not proven by any email or official letter? What should i tell management i breached contract because somebody call me?

6) You have decided to terminate a contract because you no longer need the work from the seller. 
What is the BEST way to communicate this to the seller?
A) Call the seller immediately
B) Send the seller a notification by e-mail
C) Send the seller a stop work order by overnight mail
D) Hold an immediate meeting with the seller
ANS: C

Why shouldn't you first call seller and he will stop work on contract right now and after that send a letter by overnight mail?

Regarding question 1: you need to assume that proper project management has been done. That means everything has been evaluated and documented as needed. The question will check if you understand the legal impact of procurements and that, especially with regards to procurement, everything needs to be done to ensure that you are well prepared in case you need to go to court. In this case, to keep the delivered equipment, or not immedeately send the incorrect equipment back to the seller, would be considered as kind of acceptance!!! (That is the critical topic here). Hence: send it back as soon as you can :-)


Second question: in a procurement (legal) environment formal written communication is required. Answer C is the only answer that includes formal written communication.
