thats exactly what i thought but the same question was asked in brainbok.com 50 quesions and the answer was senior management. i also remember reading someone from outside the team signs teh charter.
You will always find in some exams that some of the mock up question's answer is wrong and doesn't go with PMBOK concept or whatever you find in all the places. Best in such cases to ignore those things and always go for rule of thumb.
Senior management means could be manager to project manager and cannot be necessarily who can sign charter. SPONSOR is the keyword for signing the charter. Hope this helps.

It will always be owned by Sponsor
PM can help creating it after getting authorized but ultimate responsibility remains with Sponsor.
